Our client who was born on 27 March 1985 and had been a life long smoker, attended his GP practice on January 2009 and requested medication for assistance in trying to stop smoking.  Our client was a known epileptic and was on the prescription drug Epilim. 

His GP prescribed Zyban to assist with giving up smoking.

Our client duly took Zyban but became unwell.  He attended his GP the following week advising his GP that he was unwell. The GP failed to note his pre-existing history of epilepsy and doubled the dosage for Zyban. 

Approximately one week later, he suffered a severe epileptic seizure losing two teeth and suffering broken ribs and cuts and bruises to his chin.

He pursued a claim against the GP for prescribing Zyban which is contraindicated for persons suffering with epilepsy.  A Letter of Claim was served upon the GP surgery and liability was admitted.  The claim settled prior to the commencement of proceedings for £25,000.
